Construction Business Rules & Clauses
1. Materials Supplied by Homeowner
Any materials purchased and supplied by the homeowner will not be covered under the contractor’s warranty. The contractor will not be responsible for defects, delays, or damages caused by such materials.
2. Responsibility for Children and Pets
The contractor and workers are not responsible for the safety, supervision, or well-being of children, pets, or other individuals on the property. The homeowner must ensure a safe and distraction-free work environment.
3. Access to Property
Homeowner must provide access to the property during standard construction noise hours, seven (7) days a week, unless otherwise agreed.
4. Change Orders
Any changes in design, scope, or materials not agreed upon at the start of the project will require a written change order. Change orders will include adjusted pricing and revised timelines.
5. Unforeseen Conditions
Any unforeseen conditions or additional work discovered during the project will be documented. Such conditions may extend the project timeline and increase costs, which will be communicated to the homeowner.
6. Material Price Fluctuations
If material costs increase after the original quote is provided, the difference will be accounted for in the final invoice.
7. Workmanship Discrepancies
Any discrepancies in workmanship reported by the homeowner will be addressed and corrected within reason, in accordance with industry standards.
8. Material Costs
If the contractor is supplying materials, all material costs must be paid in full upfront prior to purchase.
9. Labor Deposits
For projects lasting longer than one (1) week, a non-refundable deposit of thirty-three percent (33%) of labor costs is required before work commences.
10. Progress Payments
Progress payments will be required at agreed-upon milestones throughout the project. Work may be paused if payments are not received in a timely manner.
11. Project Scheduling and Timeframe
Work will be scheduled and progressed alongside other active projects. Timeframes are based on active working days on-site and not continuous full calendar days. Delays due to weather, availability of materials, homeowner changes, or unforeseen conditions will extend the schedule as needed.
